1. Introduction and Service Description

DavianaTips is a digital tipping feature provided by Daviana that enables salon professionals to receive tips from clients via their own Stripe Express account.

By using DavianaTips, you are a user of the Daviana tipping interface subject to these terms. You also enter into a direct agreement with Stripe for your Express account, subject to Stripe's Connected Account Agreement.

Staff members who use DavianaTips do so at their own discretion. Participation is voluntary.

2. How It Works

Daviana provides the tipping interface and onboarding flow. When a client chooses to leave a tip, it is recorded and paid out through Stripe to the selected staff member's connected account, subject to Stripe's terms.

3. Fees

Daviana does not currently deduct any fee from tips. If this changes in the future, you will be notified in advance and asked to accept updated terms before any fee takes effect.

4. What Managers Cannot Do Through This Service

Managers cannot:

• Alter your bank details
• Accept these terms on your behalf
• Complete Stripe onboarding on your behalf
• Reassign or redistribute your tips through this flow

5. Your Obligations

You agree to:

• Use DavianaTips only for its intended purpose within your salon or spa
• Provide accurate information during Stripe registration
• Prevent unauthorised access to your account

6. Tax Responsibilities

You are responsible for your own tax obligations on tips. HMRC may collect tax through your tax code, or you may need to report tip income directly depending on your circumstances.

7. Tipping is Voluntary

Tips are completely voluntary for clients. No tip amount is preselected on the payment terminal and a clear option to skip tipping is always presented. Tips are never included as part of the service price or presented as a required charge.

Your salon or employer may have separate legal obligations under workplace tipping law (Employment (Allocation of Tips) Act 2023). These terms govern your use of the DavianaTips service and do not replace any employer obligations.

8. Privacy

Your personal data is shared with Stripe for account creation and payment processing. Data handling is governed by Daviana's Privacy Notice and Stripe's Privacy Policy.

9. Limitation of Liability

To the fullest extent permitted by law, Daviana's total liability under these terms is limited to £500. The service is provided “as is” without warranties except those required by law. Nothing in these terms limits liability for death, personal injury, or fraud.

10. Termination

You may request deactivation of your DavianaTips account at any time. Outstanding balances in your Stripe account are handled according to Stripe's terms. Daviana retains acceptance records as a compliance and evidential record.

11. Governing Law

These terms are governed by the laws of England and Wales.
